I bid on and won this auction on August 18th. The seller's PayPal account wasn't accepting payments at the time. He kept sending Paypal reminders to pay, but when I'd try to pay, it said "not accepting payments". Finally on August 27th, it worked and I immediately sent him the $89.10 for the item I won.

Time passes. We move into our new house and plan a poker tournament for Sept 11th. Surely my poker chips will be in by then! On September 7th, I send an email to him:

When can I expect to receive the poker chips? I haven't got them yet
and it's been over a week. Do you have a tracking number?

Excellent... I'll still get them in time for the poker tournament! UPS Ground from California to Arizona is generally 2 days, as estimated. Every day until the 11th we check for the package... nothing.

Finally on Monday I am pissed. It's been two weeks since I paid and I still don't have the damn poker chips. I called UPS, they confirm it hasn't shipped.

I called UPS and they said they don't have any scans of the package.
Did you ever send it? I'm getting concerned now because I paid you on
August 27th which was over two weeks ago and I don't even see any
evidence that you ever shipped what I bought. If you are out of stock
on this item, please refund my money so that I can order chips from
someone who is able to fulfill the order.

September 14th:
I see you have checked your eBay account and replied to some of the
negative feedback you're getting for other people with the same
problems as I am having. Please tell me what's going on with my chips
or refund my money so I can buy them from someone who is able to ship
them! There are plenty of other people selling poker chips on eBay.

If there is no reply to this email within 24 hours, I will initiate
all available complaint procedures available to me.

You can verify this yourself at http://feedback.ebay.com/ws1/eBayISAPI.dll?ViewFeedback&userid=babyanan -- there are many people not being shipped their items. The tracking numbers he provides show that they haven't been shipped proving him a liar.

So, after 24 hours with STILL NO REPLIES TO EMAILS, I use Paypal's Complaint procedures to request that my money be refunded. babyanan responds to the complaint by issuing a refund of my money, which I got this morning. Well, that's fine and dandy. I paid, I didn't get, I got a refund, I left negative feedback. You'd think the case would be closed and I could move on ad buy poker chips from someone else...

But babyanan had something else in store for me...

My thoughts on this can be abbreviated as "WTF"!!!! I paid the mother fucker, he didn't send my shit, I got a damn refund, and now he's putting a strike on my account saying that I didn't PAY?!

So, there are several ways you can get the strike removed. One of those is to paste the headers and contents of the payment verification email from paypal, another is that the strike will be removed if the guy left you positive feedback. Those are the two that I qualify for. So, I sent off an email to eBay with my confirmation and the fact that he left me positive feedback (which he placed right after I paid)... obviously he's just trying to retaliate for losing out on the sale. What a n00b! Seriously!

As you can see, I even withheld my negative feedback until yesterday when I issued the request for refund. This guy is a complete n00b and shouldn't be allowed to sell on eBay until he gets his head out of his ass. At least I was able to get my money back. When I first bid on this item, the only negatives he had were because people had trouble paying him with PayPal, never a problem with fulfilling the order, which is why I had decided to buy from him. I always check a seller's feedback when I buy something from them.
